By using our website www.red-onions.co.uk, you agree to be bound by Chilcote Valley Sales Ltd's Terms and Conditions, as stated below.
1.0 Contract for the Supply of Products or Services
1.1 Orders are deemed to be an offer by the Buyer to purchase Goods from Chilcote Valley Sales Ltd subject to availabilty and to acceptance by the Seller; Chilcote Valley Sales Ltd.
1.2 If, by error we have under priced an item, we will not be liable to supply that item to you at the stated price, provided that we notify you before we despatch the item to you. In those circumstances, we will notify the correct price to you so you can decide whether or not you wish to order the item at that price.
1.3 Price and availability information is subject to change without notice.
1.4 Payment for the price of the products shall be due in pounds sterling at the time of the order.
1.5 Chilcote Valley Sales Ltd and their associate sites is only able to offer deferred paymnent with purchases made directly through a Red Onions website, orders placed over the phone and through any other selling channel may be debitied at the point of sale at which point the customer will then be covered by Red Onions refund and cancellation policy.
1.6 Red Onions and Chilcote Valley Sales Ltd reserves the right to release deferred payments up to the value of the order total at any time, at which point the customer will then be covered by Red Onions refund and cancellation policy.
1.7 Time of payment shall be of the essence and no payment shall be deemed to be received by us until it has been received in full and cleared funds.
2.1 Chilcote Valley Sales Ltd is providing this site and its contents on an as is basis and makes no representations or warranties of any kind with respect to this site or its contents. Chilcote Valley Sales Ltd disclaims all such representations and warranties, including for example warranties of merchantability and fitness for a particular purpose. In addition, Red Onions Ltd does not represent or warrant that the information accessible via this site is accurate, complete or current.
2.2 We shall endeavour that all orders are met. We do not, however, guarantee the availability of any product at any time. Where a product is temporarily out of stock we will either advise you of when we expect to be able to fulfil orders, however this is an estimate only and shall not be binding upon us or return, source an alternative supplier or refund your payment to the values of the item ordered.
2.3 Sometimes stock may be withdrawn or discontinued. We shall make every effort to update the website at all times, but you understand and acknowledge that we are not liable to you for any failure or delay to fulfil an order due to products being out of stock, withdrawn or discontinued.
2.4 The stock level, stock level indicator is not a live stock level indicator and may not represent the true stock level carried by us, Red Onions, our distributors and suppliers.
2.5 All products carry the warranty stated on the product description and we shall only extend the benefit of the manufacturer's warranty to you, and do not separately warranty the products ourselves.
2.6 In the event of the product requiring replacement or repair under the warranty, you must contact the manufacturer directly.
Processing of orders
3.1 Credit cards are debited before items are shipped
3.2 You must ensure that the terms of your order, including the address for delivery, and email addresses are complete and accurate. Red Onions and Chilcote Valley Sales Ltd accept no liability for inaccurate details.
3.3 Delivery of the products shall take place at the registered address of the payment card.
3.4 Once we have dispatched the products we are unable to cancel any orders.
3.5 Any dates or times specified by us for delivery of the products are intended to be estimates only and time of delivery shall not be of the essence, and shall not be made of the essence by notice
3.6 Subject to the other provisions contained in these terms and conditions, we shall not be liable for any direct, indirect or consequential loss (all three terms which include, without limitation, pure economic loss, loss of profits, loss of business, depletion of goodwill and similar losses), costs, damages or expenses caused directly or indirectly by any delay in the delivery of the products (even if caused by our negligence).
3.7 If for any reason you or the person at the delivery address refuses to accept delivery of the products, all risk in the products shall pass to you and we may, at our discretion, charge for return of the products to us, a storage fee and a redelivery fee to another address nominated by you.
3.8 FREE UK delivery is offered only to a UK delivery address; additional charges will be added to any order with a delivery address is outside of the UK. Free UK delivery is our standard delivery service and may take upto 5 days from dispatch dependent on the delivery method we use. If a faster delivery is requried then the cost of delivery shall be calculated when you place your order with us and payment shall be due at the time of payment for the products.
3.9 The price for the products shall be inclusive of VAT (unless otherwise stated) and inclusive of all fees and charges in relation to packaging, carriage (standard delivery) and insurance to the delivery address.
4.1 You can cancel your contract at any time up to 14 working days after the day of delivery. To do this, please e-mail us or write to us.
4.2 You do not have to give any reason for cancellation. However, a brief explanation will help us to improve the service we offer to customers in the future.
4.3 If you cancel, you must return the goods to us at your own expense. You must ensure that the goods are packaged adequately to protect against damage.
4.4 If you fail to return the goods, we will collect them, and we will charge you the direct cost of collection. If you fail to take reasonable care of the goods before they are returned to us, and this results in damage or deterioration, we will charge you for the reduction in value.
This cancellation policy does not affect your legal rights - for example, if goods are faulty or misdescribed.
Returns and Refund Policy
5.1 In the event that any order is incorrect, it must be notified to us within 7 (seven) days after delivery and we shall redeliver the correct order at our own cost..
5.2 If any products are faulty or defective, we must be notified within 1 (one) month of delivery and the goods returned to us. At our own discretion, we shall replace or repair the products free of charge and redeliver them at our own cost, or shall provide a refund of the price paid by you. In the event of replacement of any products, the products returned to us shall become our property.
Limitation of Liability
Except as specifically stated on this site, neither Chilcote Valley Sales Ltd nor any of its directors, employees or other representatives will be liable for damages arising out of or in connection with the use of this site. This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties.

Changes in Terms
Red Onions Ltd reserves the right to modify these terms at any time without prior notice. Any modification of these terms will be deemed to be effective from the date and time of posting on the Chilcote Valley Sales Ltd web site.
